General Terms and Conditions

Updated: 13 October 2026

I. Introductory provisions

1.1 These general terms and conditions (hereinafter referred to as "GTC") govern the conditions relating to the conclusion of an accommodation contract between the customer and the accommodation provider, which the contracting parties may also conclude remotely via the website www.myhotel.sk and its functionalities (hereinafter referred to as the "website") or via email.

1.2 The accommodation provider is the commercial company SENGER & Partners s. r. o., ID No. 45 339 856, with its registered office at Štefánikova 5, 811 06 Bratislava, Slovak Republic, VAT No. 2022986603, VAT ID SK2022986603, registered in the Commercial Register of the Municipal Court Bratislava III, Section Sro, File No. 63477/B, e-mail: info@senger.sk, tel. no. +421 2 2070 7111 (hereinafter referred to as the "accommodation provider"), which operates several accommodation facilities for temporary accommodation.

1.3 The customer is any natural or legal person who expresses interest in concluding an accommodation contract with the accommodation provider and makes a binding order with an obligation to pay (hereinafter referred to as the "customer").

1.4 If the customer is a natural person who, in connection with the accommodation contract, is not acting within the scope of their business or profession, they are considered a consumer and, as such, are entitled to increased legal protection under the legal system of the Slovak Republic and these GTC.

1.5 The accommodation contract is a contract concluded in accordance with § 754 et seq. of Act No. 40/1964 Coll. Civil Code, as amended, other relevant legal regulations effective in the Slovak Republic and these GTC between the customer and the accommodation provider, which came into existence upon acceptance of the customer's order by the accommodation provider and on the basis of which the accommodation provider provides the guest with temporary accommodation for a fee (hereinafter referred to as the "accommodation contract"). In addition to these GTC, the accommodation provider's accommodation rules form an integral part of the accommodation contract.

1.6 The customer and the guest do not have to be the same person, but the customer is obliged to accurately identify in the order all natural persons who are to be accommodated by the accommodation provider on the basis of the order (hereinafter referred to as "guests"), for whom the customer is fully responsible and whose actions are considered, for the purposes of the accommodation contract, to be the actions of the customer. The customer is entitled to unilaterally change the person of the guest, but is obliged to notify the accommodation provider in advance, and this change does not constitute a change to the order.

1.7 A room is a space reserved by the accommodation provider for temporary accommodation, which consists of a living room or a set of living rooms with accessories arranged into a functional unit with its own lock, which is intended for temporary accommodation and is located in an accommodation facility operated by the accommodation provider (hereinafter referred to as "room").

1.8 The accommodation provider currently operates the following accommodation facilities:

  • le Petit ***, Suché mýto 19, Bratislava,
  • Garni hotel VIRGO ***, Panenská 14, Bratislava,
  • Downtown Bratislava B&B ***, Panenská 31, Bratislava,
  • Elisabeth Old Town ***, Klemensova 2, Bratislava,
  • BlueBell Hotel ***, Paulinyho 14, Bratislava,
  • 7 Days B&B ***, Panenská 34, Bratislava,
  • Petit Dependance ***, Panenská 36, Bratislava,
  • Hotel ANTARES ****, Šulekova 15, Bratislava,
  • Apart Hotel Virgo ****, Panenská 5, Bratislava,
  • Metropolitan Star Apart Hotel ****, Námestie 1. mája 9, Bratislava,
  • Hotel Reverie ***, Vysoká 27, Bratislava,
  • Elysian Apartment, Námestie 1. mája 15, Bratislava,
  • P23 Apartments, Panenská 23, Bratislava,

(hereinafter collectively and individually referred to as "accommodation facilities").

II. Conclusion of the accommodation agreement

2.1 The accommodation contract is concluded on the basis of a binding order with an obligation to pay made by the customer (hereinafter referred to as the "order"), which the accommodation provider has accepted.

2.2 The customer may place an order:

  1. via the website,
  2. via email,
  3. in person.

2.3 Orders cannot be placed by telephone. Any room reservation made by the customer by telephone is not legally binding. The accommodation provider will endeavor to accommodate such requests to the extent possible, but in view of its economic activities, it is entitled to give priority to legally binding orders in the event of capacity constraints.

2.4 After the customer has selected the individual parameters of the order, in particular the selected accommodation facility, the length of stay, the room standard, and filled in the details of the customer and the guest, the system will generate a summary of the entire order for orders placed via the website. When using other methods of ordering, the accommodation provider will generate a summary of the entire order. The customer then has the opportunity to check and change the information entered in their order, or to identify and correct any errors made when entering the information into the order. Only after the customer agrees to their entire order and also agrees to the wording of these GTC and the accommodation provider's accommodation rules, which are an integral part of the accommodation contract, as well as to the terms and conditions of personal data protection, the customer shall, when placing an order via the website, click on the "Order with payment obligation" button on the website, and when placing an order by other means, shall attach their handwritten signature to their order with the note "Order with payment obligation".

2.5 Acceptance of the order by the accommodation provider constitutes conclusion of the accommodation contract. The customer shall be informed of the accommodation provider's decision to accept the order made in accordance with paragraph 2.4 of the GTC:

  1. for orders placed via the website, by displaying the message "Order with payment obligation accepted" directly on the website or by sending the customer an email from the accommodation provider with the subject line "Order with payment obligation accepted," to which the following will be attached:
  • a summary of the customer's entire order,
  • a pro forma invoice if the customer has not paid for the accommodation via the website's payment gateway, or an invoice if the customer has paid for the accommodation via the website's payment gateway,
  • a sample form for withdrawal from a distance accommodation contract, if the customer is a consumer,
  • instructions on exercising the consumer's right to withdraw from a distance accommodation contract, if the customer is a consumer.

The accommodation provider is not obliged to accept the customer's order, therefore if within 24 hours of placing the order, the customer does not see the message "Order with payment obligation has been accepted" on the website or if the customer does not receive an email message in accordance with this section of the GTC, the accommodation contract will not be concluded and the order with payment obligation will be canceled from the outset;

  1. for orders placed via email, the accommodation provider will send the customer an email message titled "Order with payment obligation received," which will include the following attachments:
  • a summary of the customer's entire order,
  • a pro forma invoice,
  • a sample form for withdrawal from a distance accommodation contract, if the customer is a consumer,
  • instructions on exercising the consumer's right to withdraw from a distance accommodation contract, if the customer is a consumer.

The accommodation provider is not obliged to accept the accommodation order, therefore if within 48 hours of delivery of the order the customer does not receive an email message in accordance with this section of the GTC, the accommodation contract will not be concluded and the order with the payment obligation will be canceled from the outset;

  1. when the order is placed in person by the customer at the accommodation facility.

The accommodation provider is not obliged to accept the order, which they will inform the customer of immediately during their personal visit, and in such a case, no accommodation contract will be concluded.

2.6 If the advance payment for accommodation is not made in accordance with the order, the accommodation contract shall be canceled from the outset.

2.7 The guest is not entitled to use temporary accommodation at the accommodation provider's premises before the advance payment for accommodation has been made in accordance with the order.

III. Temporary accommodation

3.1 The accommodation provider provides temporary accommodation in rooms located in accommodation facilities operated by them.

3.2 The exact address of the accommodation facility where the room is located, as well as the standard of the room and, where applicable, other services related to the accommodation, are based on the customer's selection made when placing their order from the accommodation provider's offer.

3.3 Each room assigned to a guest on the basis of an order is in a condition suitable for proper use and ensures that the guest can exercise their rights associated with accommodation without interference.

3.4 The guest has the right to propose additional changes to the accepted order at any time or to request the provision of additional services related to accommodation. The accommodation provider will attempt to accommodate the guest's legitimate requests, if its operational capabilities allow.

3.5 The client assures the accommodation provider that every adult guest listed in the order is authorized to act on behalf of and for the account of the client in connection with the accommodation contract, and that all actions of the guest in any way related to the accommodation contract are directly binding on the customer in relation to the accommodation provider, including any compensation for damages.

3.6 The customer undertakes to inform the guest, prior to their arrival, of the content of their order accepted by the accommodation provider, as well as these GTC, the accommodation provider's accommodation rules, and the accommodation provider's Personal Data Protection Policy.

3.7 The client undertakes to compensate the accommodation provider for any damage caused by the guest.

IV. Period of temporary accommodation

4.1 The accommodation provider shall provide the guest with a room for a fixed period of time, as specified by the customer in their order.

4.2 The exact time of temporary accommodation is specified in the order, whereby the guest may check in no earlier than 2:00 p.m. on the first day of accommodation (hereinafter referred to as "check-in") and must vacate the room by 11:00 a.m. on the last day of accommodation (hereinafter referred to as "check-out").

4.3 A customer who is a consumer and has placed their order via the website or email may begin using temporary accommodation with the accommodation provider earlier than 15 days after concluding the accommodation contract only if they give their express consent to the commencement of temporary accommodation before the expiry of the statutory 14-day period for withdrawal from the accommodation contract. If the customer, who is a consumer, gives their consent to the commencement of temporary accommodation before the expiry of the statutory 14-day period for withdrawal from the accommodation contract, then, if they decide to withdraw from the accommodation contract during the statutory 14-day period, they will have to pay the accommodation provider a proportionate part of the price for accommodation from the beginning of the temporary accommodation until the withdrawal from the accommodation contract. If the entire period of temporary accommodation expires before the expiry of the statutory period for withdrawal from the accommodation contract and the customer has not withdrawn from the accommodation contract during that period, the customer, who is a consumer, has lost the right to withdraw from the accommodation contract.

4.4 If the guest decides to extend the period of temporary accommodation, they are obliged to inform the accommodation provider of this before the end of the original period of temporary accommodation, i.e. before check-out. The accommodation provider may agree to this, but is not obliged to do so. If the accommodation provider does not agree to extend the period of temporary accommodation, the guest is obliged to vacate the room in accordance with the original order. If the accommodation provider agrees to extend the period of temporary accommodation, the original accommodation contract is amended in the part concerning the end of the period of temporary accommodation and, consequently, the price of accommodation is adjusted proportionally.

V. Accommodation price and payment terms

5.1 The total price for accommodation is the sum of the price for temporary accommodation, related services provided by the accommodation provider and selected by the customer or guest, and accommodation tax.

5.2 The total price for accommodation is stated including value added tax (VAT) in accordance with the current legislation of the Slovak Republic.

5.3 The total price for accommodation depends on several parameters selected by the customer in their binding order with payment obligation, such as the selected accommodation facility, room standard, or length of stay, or options selected by the guest during their stay, such as extending their stay or providing services related to accommodation. The total price for accommodation may therefore differ from the price for accommodation stated in the order, but only to the extent that the guest chooses during their stay beyond the scope of the original order from the accommodation provider's offer, which also specifies the exact price for individual services.

5.4 The advance payment for accommodation is payable in advance, with the exact amount specified in the order.

5.5 The guest is obliged to check out of the accommodation immediately after vacating the room and pay the total price for the accommodation, reduced by the advance payment. The guest and the accommodation provider may agree that, instead of paying the total price for accommodation reduced by the advance payment, the guest will confirm with their own signature upon leaving the room that they have received the accommodation provider's invoice for payment of this amount due.

5.6 The total price for accommodation and any of its components must be paid to the accommodation provider in euros, either in cash or by bank transfer. The accommodation provider's payment details are: bank connection: Tatra banka, account number (IBAN) SK 42 1100 0000 0029 2283 2945, BIC TATRSKBX

5.7 If the accommodation provider is obliged to make any payment to the customer, it shall be made by bank transfer to the account number (IBAN) specified by the customer in their order, unless the customer has notified the accommodation provider of a different account number (IBAN) in the meantime.

VI. Termination of the accommodation agreement

6.1 The accommodation contract shall terminate:

  1. upon expiry of the agreed period of accommodation,
  2. by written agreement of the contracting parties,
  3. by written withdrawal.

6.2 The contracting parties agree that the accommodation provider has the right to withdraw from the accommodation contract if:

  1. the guest grossly violates his/her obligations arising from generally binding legal regulations or from the accommodation contract, including these GTC and the accommodation rules,
  2. stays in the accommodation facility despite a warning and grossly violates good manners,
  3. is unable to provide the guest with a room in accordance with the order in a condition suitable for proper use or in a condition that allows for the undisturbed exercise of rights associated with accommodation,
  4. there was a technical error in the information system when placing or receiving the order (e.g., incorrect prices, duplication, non-functional payments) on the part of the accommodation provider, including errors on the website.

Such withdrawal shall take legal effect upon delivery to the customer or the accommodated person.

6.3 A customer who is a consumer is entitled to withdraw from the accommodation contract without giving any reason within 14 days of the date of conclusion of the accommodation contract. In such a case, the customer who is a consumer is obliged to pay the accommodation provider only a proportionate part of the price for accommodation from the beginning of the temporary accommodation until the withdrawal from the accommodation contract, and the accommodation provider is obliged to return to the customer who is a consumer, within 14 days from the date of delivery of the notice of withdrawal from the accommodation contract, all payments received from them on the basis of the accommodation contract and the customer is not obliged to pay them. Such withdrawal, as well as withdrawal pursuant to paragraph 6.4 of the GTC, has legal effect upon delivery to the accommodation provider.

6.4 The contracting parties agree that, except for the situation described in paragraph 6.3 of the GTC, each customer has the right to withdraw from the accommodation contract at any time without giving a reason. In such a case, however, the customer is obliged to compensate the accommodation provider for the damage incurred by the early cancellation of the accommodation by the customer, in a total amount consisting of the following items:

  • the amount of transaction tax that the accommodation provider must pay in connection with the refund of funds to the customer, and
  • the price of services already consumed by the guest under the accommodation contract, and
  • the relevant portion of the total price for accommodation that the guest did not use, in the amount of:
  • 0% if the customer withdraws from the accommodation contract at least 60 days before the first day of the agreed accommodation period,
  • 30% if the customer withdraws from the accommodation contract at least 40 days before the first day of the agreed accommodation period,
  • 60% if the customer withdraws from the accommodation contract at least 20 days before the first day of the agreed accommodation period,
  • 80% if the customer withdraws from the accommodation contract at least 10 days before the first day of the agreed accommodation period,
  • 100% if the customer withdraws from the accommodation contract less than 10 days before the first day of the agreed accommodation period.

6.5 If the guest decides not to stay with the accommodation provider in accordance with the accommodation contract or decides to check out early, this is a proper exercise of their rights, which, however, has no effect on the content of the duly concluded accommodation contract.

VII. Complaint

7.1 The accommodation provider is responsible for ensuring that the room is in a condition suitable for proper use and for ensuring that the guest can exercise their rights associated with the accommodation without interference.

7.2 The accommodation provider is liable for any defects in the room during the term of the accommodation contract. The accommodation provider is also responsible for defects in services related to accommodation. The accommodation provider is not responsible for defects arising from the improper use of the room or services related to accommodation by the guest, or from a breach of obligations by the guest or a person whom the guest has allowed to enter the room or accommodation facility of the accommodation provider.

7.3 If the customer or guest believes that the room or any other service provided by the accommodation provider does not comply with the terms and conditions agreed in the accommodation contract, the customer or, on their behalf, the guest is entitled to file a complaint with the accommodation provider without undue delay, from the moment when the customer or guest could have discovered the defects in question with normal diligence.

7.4 Complaints may be lodged by the customer or by the guest acting on behalf of the customer in writing to the accommodation provider in electronic form by email to: reklamacie@senger.sk, in paper form at the address: SENGER & Partners s. r. o., Štefánikova 5, 811 06 Bratislava, or at the reception desk of the accommodation facility.

7.5 Upon receipt of the complaint, the accommodation provider shall provide the customer with written confirmation of the complaint.

7.6 The accommodation provider is obliged to handle the complaint without delay, no later than 30 days from the date of filing the complaint.

7.7 If the customer is not satisfied with the handling of the complaint or believes that the accommodation provider has violated their rights, they have the right to contact the accommodation provider with a request for redress. If the accommodation provider rejects such a request or does not respond to it within 30 days, the customer, who is a consumer, has the right to file a proposal for alternative dispute resolution with an alternative dispute resolution entity. The alternative dispute resolution entity is: Slovak Trade Inspection, Bajkalská 21/A, 827 99 Bratislava, or another competent legal entity registered in the list of alternative dispute resolution entities maintained by the Ministry of Economy of the Slovak Republic, link: https://www.mhsr.sk/obchod/ochrana-spotrebitela/alternativne-riesenie-spotrebitelskych-sporov-1/zoznam-subjektov-alternativneho-riesenia-spotrebitelskych-sporov-1. A customer who is a consumer is entitled to choose the alternative dispute resolution entity to which they will turn.

VIII. Personal data

8.1 The accommodation provider has taken appropriate technical, organizational, and personnel measures corresponding to the method of personal data processing, taking into account, in particular, the applicable technical means, the confidentiality and importance of the personal data being processed, as well as the extent of possible risks that could compromise the security or functionality of its information systems within the meaning of Regulation (EU) 2016/679 of April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and Act No. 18/2018 Coll. on the protection of personal data. The customer and the guest agree to the processing of their personal data in accordance with these rules under the Terms and Conditions of Personal Data Protection by the accommodation provider (hereinafter referred to as "GDPR"), which are available here.

IX. Vis maior

9.1 The contracting parties shall not be liable for non-performance or delay in performance of obligations arising from the accommodation contract if this is due to force majeure, which includes, in particular, natural disasters, epidemics, war, martial law, mass power outages, technical accidents, decisions of public authorities, and other unforeseeable events beyond the control of the contracting party concerned.

9.2 The contracting party invoking force majeure is obliged to inform the other contracting party of this fact without undue delay.

9.3 The duration of force majeure extends the deadlines for fulfilling obligations by the duration of its occurrence.

X. Delivery

10.1 All legal acts for which the accommodation contract or generally binding legal regulations require written form shall be delivered by the customer and the accommodation provider in electronic form or in paper form, either in person, via the website, post, or email to their contact details specified in the order, unless the contracting parties have notified each other of a change.

10.2 For reasons of speed and efficiency, personal communication or electronic communication via e-mail between the customer and the accommodation provider is preferred in connection with the accommodation contract. Documents delivered in electronic form have the same effect as documents delivered in paper form.

10.3 Both the customer and the accommodation provider undertake to check their email inbox, including spam, and to ensure its functionality and deliverability.

10.4 Any change of e-mail or postal address must be notified to the other contracting party without delay. Only from the moment of this notification is the other contracting party obliged to start using the new address for delivery.

10.5 Documents delivered via the website or email are considered delivered at the moment of their dispatch.

10.6 Documents delivered in paper form by post shall be deemed to have been delivered on the date of their receipt, on the date of refusal to accept them, or on the date of their return to the sender if the shipment was not delivered for any reason.

10.7 Documents delivered in paper form in person shall be deemed to have been delivered on the date of their receipt or on the date of refusal to accept them.

XI. Final provisions

11.1 These GTC are an integral part of the accommodation contract.

11.2 Legal relations established by the accommodation contract are governed by the legal order of the Slovak Republic.

11.3 The client and the accommodation provider shall endeavor to resolve any disputes primarily by mutual agreement. If the dispute cannot be resolved by mutual agreement, either party shall be entitled to refer the matter to the competent court. All disputes arising from or in connection with the accommodation contract shall be decided exclusively by the competent courts of the Slovak Republic.

11.4 If any of the accommodation provider's documentation is also available in a language other than Slovak, in the event of a dispute between the Slovak language version and the version in another language, the Slovak version shall take precedence.

11.5 The terms used in these GTC apply with the same content to any other documentation of the accommodation provider. In the event of a discrepancy in the definition of the same term in different documents of the accommodation provider, the definition agreed in the relevant document shall take precedence over the wording of these GTC.

11.6 The Accommodation Provider reserves the right to change these GTC at any time, with the new GTC becoming valid on the date of their publication on the website and effective on the date specified in the amended GTC, which may not be earlier than the date of their publication on the website.

11.7 The GTC, accommodation rules, and GDPR are available on the website and at the reception desk of the accommodation facility.

11.8 These GTC become valid and effective on 1 August 2025.
